§ 01

General Provisions

These Terms of Service ("Terms") govern access to and use of the website available at https://world3zero.org ("Website") and all services provided through it.

By accessing the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms in full, you must discontinue use of the Website immediately.

These Terms are published pursuant to Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services (Dz.U. 2002 nr 144 poz. 1204, as amended).

§ 02

Definitions

  • Operator — World 3.0 Foundation, registered at 26 Bolesława Chrobrego Street, 81-783 Sopot, Poland.
  • Website — the online service available at https://world3zero.org, including all subpages, language versions and resources.
  • User — any natural person, legal entity, or organisational unit accessing the Website.
  • Services — all functions made available through the Website, including publication of content and donation processing.
  • Donation — a voluntary financial contribution to the Operator made through the Website or by bank transfer.
  • GDPR — Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

The Operator is a non-profit foundation established under the Polish Act of 6 April 1984 on Foundations. It is not entered in the Register of Entrepreneurs and conducts no economic activity. Details of its governance are set out on the Governance page.

The Operator's non-profit status has been independently verified by the following organisations:

  • Google for Nonprofits / Google Grants — verified non-profit eligible for the Google Ad Grants programme;
  • Goodstack (formerly Percent) — verified non-profit organisation listed in the Goodstack global registry;
  • European Commission Funding & Tenders Portal — registered participant, Participant Identification Code (PIC): 864480103.

§ 04

Scope of Services

Through the Website, the Operator provides the following services free of charge:

  • publication of editorial content, research materials, and reports relating to the Operator's statutory activities;
  • information about the Operator's projects, events, and initiatives;
  • provision of contact forms and communication channels;
  • acceptance of voluntary donations via online payment systems and bank transfers.

The Operator reserves the right to modify the scope, functionality, or availability of Services at any time without prior notice, where such changes do not affect Users' acquired rights.

§ 05

User Obligations

Users access and use the Website at their own risk and responsibility. Each User agrees to:

  • use the Website solely for lawful purposes consistent with applicable Polish and EU law;
  • refrain from transmitting unsolicited commercial communications (spam);
  • refrain from any activity that disrupts or impairs the functioning of the Website or its infrastructure;
  • refrain from attempting unauthorised access to any part of the Website or its underlying systems;
  • provide accurate and truthful information where submission of personal data is required.

Any violation of these obligations entitles the Operator to block the User's access without prior warning.

§ 06

Intellectual Property

All content published on the Website — including texts, graphics, photographs, logos, and the overall visual design — constitutes works protected under the Polish Act of 4 February 1994 on Copyright and Related Rights and Directive 2001/29/EC on the harmonisation of certain aspects of copyright.

The Operator grants Users a non-exclusive, non-transferable licence to view Website content for personal, non-commercial purposes only. Any reproduction, distribution, public performance, or creation of derivative works requires the Operator's prior written consent.

Use falling within the statutory exceptions to copyright under Polish law (dozwolony użytek, Articles 23–35 of the Act on Copyright and Related Rights) — including quotation for the purposes of criticism, review, teaching or scientific analysis — does not require separate authorisation, provided the source and author are clearly credited.

§ 07

Donations & Payments

Donations to the Operator are voluntary and constitute a gift within the meaning of Articles 888–902 of the Polish Civil Code. They are non-refundable unless a technical error caused an unintended charge. Requests for refund on this basis must be submitted to office@world3zero.org within 14 days.

The Operator carries out public benefit activity within the meaning of the Polish Act of 24 April 2003 on Public Benefit Activity and Volunteerism. It does not hold the registered status of a public benefit organisation (organizacja pożytku publicznego) and therefore may not receive allocations of 1.5% of personal income tax.

Donations may qualify for a tax deduction under Article 26(1)(9) of the Polish Personal Income Tax Act, and under Article 18(1)(1) of the Corporate Income Tax Act for legal entities. The Operator does not provide tax advice; donors should verify their entitlement with a qualified adviser or their local tax authority.

§ 08

Personal Data

The Operator processes personal data as controller within the meaning of Article 4(7) GDPR. Data are collected only when Users provide them voluntarily — for example, through contact forms or donation processes.

Legal bases for processing include Article 6(1)(a) GDPR (consent, in particular for newsletters and non-essential cookies), Article 6(1)(b) (performance of a contract or pre-contractual steps), Article 6(1)(c) (compliance with a legal obligation, in particular accounting duties), and Article 6(1)(f) (legitimate interests of the Operator).

Users retain the following rights under Articles 15–22 GDPR: access, rectification, erasure, restriction, portability, objection, and withdrawal of consent. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal. Requests may be submitted to office@world3zero.org. Users also have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes UODO), ul. Stawki 2, 00-193 Warsaw.

Retention periods, categories of recipients and information on any transfers outside the European Economic Area are set out in the Operator's Privacy Policy, available on the Website.

§ 09

Cookies

The Website uses cookies — small text files stored on Users' devices. Cookies are used in two distinct categories.

  • Essential cookies, necessary for the Website to function and to record cookie preferences. These are stored on the basis of Article 173(3) of the Polish Telecommunications Law and require no consent.
  • Analytics and other non-essential cookies, used to measure traffic and improve the Website. These are stored only after the User has given prior, active and informed consent through the consent banner.

Consent is not inferred from continued browsing, scrolling, or closing the banner. It may be withdrawn at any time with the same ease as it was given, through the cookie settings available on the Website or through browser settings. Withdrawal does not affect the lawfulness of processing carried out beforehand.

Disabling non-essential cookies does not restrict access to Website content. This section implements Directive 2002/58/EC as amended by Directive 2009/136/EC, together with Articles 4(11) and 7 GDPR.

§ 10

Limitation of Liability

The Operator makes reasonable efforts to ensure the accuracy and currency of Website content. However, all information is provided "as is" without warranties of any kind, express or implied.

Subject to the paragraph below, the Operator is not liable for:

  • temporary unavailability of the Website due to technical maintenance or force majeure;
  • content on external websites linked from the Website;
  • consequences of Users' reliance on information published on the Website for decisions of a legal, financial, medical, or other professional nature;
  • damages arising from unauthorised access to User data where such access resulted from circumstances beyond the Operator's reasonable control.

Nothing in these Terms excludes or limits liability which cannot be excluded or limited under applicable law. In particular, liability for damage caused intentionally may not be excluded in advance (Article 473 § 2 of the Polish Civil Code), and mandatory consumer protection provisions under EU and Polish law apply in full.

§ 11

Amendments to the Terms

The Operator reserves the right to amend these Terms at any time. Amendments take effect upon publication of the updated version on the Website, together with the new effective date and version number. Continued use of the Website following publication constitutes acceptance of the revised Terms.

Material changes affecting Users who have provided personal data will be communicated by email where technically feasible.

§ 12

Governing Law & Jurisdiction

These Terms are governed by the law of the Republic of Poland. Disputes arising from or related to these Terms shall be submitted to the court of competent jurisdiction for the city of Gdańsk, unless mandatory provisions of consumer protection law designate a different forum.

The European Online Dispute Resolution platform was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228, which repealed Regulation (EU) No 524/2013. Consumers seeking out-of-court dispute resolution may consult the list of certified dispute resolution bodies maintained by the European Commission at consumer-redress.ec.europa.eu. In Poland, consumers may also contact the Trade Inspection Authority (Inspekcja Handlowa) or a municipal consumer ombudsman (miejski rzecznik konsumentów).
